GOKIDDEE is a marketplace to connect Buyers and Sellers for Buying/Selling Kids products that are preloved or Eco-friendly. The Company has developed and operates an online platform that facilitates a user (“Buyer”) to purchase kid’s products.

• That are pre-owned and used, such as clothing, footwear, toys, games and other related products (“Products”) from another user (“Seller”) who has listed its’ Products on the Platform (hereinafter referred to as “Services”).
• That are new eco-friendly/environmental friendly/organic products.
• That are available for rent for short term use like books, Party wear/ethnic clothes, Strollers, High chairs, cycles etc.

It is hereby clarified that, apart from the photographs or videos that are uploaded while listing the Products, the Company will generally keep the identity and any other information of the Seller/Vendor confidential while providing the Services on the Platform. The term “Services” refers to any services provided by us on the Platform for your use. The Company reserves the right to charge for any or all Services offered by it and to modify the pricing of, add to, or discontinue the Services or any portion thereof with or without prior notice.

The Services provided by the Company to you under the Agreement shall be:

• Provided on a non-exclusive basis;
• Used by the user only for lawful activities; and
• Non-transferable and non-assignable by the user whether directly or indirectly.

Seller

“Seller” is a person who lists their products either new/preloved on our platform for sale. The Seller of the products is guided by the listing guidelines of the Company and policies prescribed by the Company from time to time. The Seller shall ensure that any listing of products complies with the following terms and conditions.

General

1. The products that can be listed are kids products for the ages 0-18 years and includes mom’s maternity/ nursing products also.
2. The Seller shall, while listing its’ Products on the Platform, only upload real and original pictures of the actual Product which he/she intends to sell on the Platform. The Seller agrees that the Products listed by him/her on the Platform should be listed exclusively on the Platform and should not be listed on any other online platform or be sold by him by any offline means.
3. The Seller shall immediately inform the Company in case the Products listed on the Platform are unavailable for sale. If the same is not communicated and the Seller is unable to deliver the Product, for any reason whatsoever, a penalty at the rate of 10 (ten) percent of the value of such Product will be deducted by the Company from the next sale made by the Seller on the Platform.
4. The Company reserves the right to delist any Product listing in its sole and absolute discretion on any ground, including contravention of any provisions of this Agreement or listing of Product being inappropriate for sale on the Platform.
5. The Company reserves the right to block any User form using the Platform, if, in the reasonable opinion of the Company, such User has contravened any provision of this Agreement or if such User has conducted himself/ herself in an unfair, unprofessional or unlawful manner.
6. The Seller shall abide by the Company’s packaging policy and that no open box delivery applicable for any orders for the Products.
7. The Seller agrees that in case the Product does not live up to the specified image/condition as described by Seller on the Platform, the Company reserves the right to void such sale, return the Product from the Buyer to Seller, with the return shipping cost charged to such Seller.

New

1. The products that are organic/ eco-friendly / environmentally friendly or manufactured out of recycled materials can be listed for sale.

Preloved

What Can Be Sold

1. Any kids’ product which is in good and usable condition can be sold.
2. Products include but not limited to products like clothes, books, footwear, Kids gear, Mom nursing items, Kids Furniture, Kids cycles, riders’ scooters etc.

What Cannot Be Sold As Preloved

1. Used Bottles.
2. Items below Rs 500 as its not feasible to bear delivery costs for low value product sales.
3. Daily wear Clothes which are used atleast once/twice.
4. Used Creams/ Body hygiene relate products.
5. Fraudulent, any illegal, counterfeit, stolen products;
6. Products of which you are not the lawful owner or you do not have the authority or consent to 'list' which do not belong to you or you do not have the authority for;
7. Products that are harmful;

Process

1. A person has to register as a Seller if he/she wants to sell a product.
2. Registration as seller is absolutely free, but the seller has to fill up all the fields mandatorily for the purpose of registration.
3. One has to select the appropriate category for the product for listing.
4. Once category is identified, the details of the product to be provided mandatorily without which product will not be accepted for listing

6. Should the product not live up to its image, we reserve the right to void the sale and return the product at your cost.
6. Once complete details have been provided as above, if your item is accepted as fit to list by us, it will go up on our Website and Social Sites. On average an item takes anything between 10 – 45 days to be listed and sold.
7. Seller should not contact repeatedly and put pressure to Sell the product.
8. Seller is allowed to reduce the price (only price and cannot change any other details) for one time during the listing time.
9. Once sale is confirmed our team member shall contact you to collect the item and collect necessary details to complete the financial transaction for the same. All the above shall be completed within 3-5 working days.
10. Seller has to pack the product as per the packing guidelines and keep the product ready for shipping with 3-5 days from the date of intimation from Gokiddee that financial transaction is completed and the sale is concluded.
11. Each product shared / listed on Gokiddee should not be listed on any other social media platforms / links / websites etc.

Buyer

“Buyer” is a person who purchased products, a member who subscribes products rent, that are listed on our platform either new/preloved/Rental. The Buyer of the products is guided by the Purchase guidelines of the Company and policies prescribed by the Company from time to time. The Buyer shall ensure that any purchase of products complies with the following terms and conditions. As a Buyer when you are purchasing a Product from the Platform, you agree:

• To buy the Product in the condition detailed through the pictures, videos, and details provided by the Seller;
• That once you purchase the Product from the Platform, the said sale will be considered final, except as otherwise provided herein;
• That except for any discounts and offers that the Company may provide from time to time, the sale price of the Product as listed on the Platform is fixed; and
• The Buyers are expected and required to exercise such reasonable diligence as one would in traditional offline channels and practice judgment and common sense before committing to or complete intended sale, purchase of any Products from the Platform.
• In addition, the Agreement may be further supplemented by Product specific conditions, which may be displayed with that Product. The Company does not warrant that Product description or other content on the Platform is accurate, complete, reliable, current, or error-free and assumes no liability in this regard.

Process

1. A person has to register as a buyer to buy products listed on GOKIDDEE.
2. All purchases will be facilitated through our Website.
3. Buyers to note that the website has new products, Used/ Preloved products and for rental.
4. Buyer has to review the complete details like features, brand, status of the product, photos, videos displayed for the product before placing the orders
5. Once orders is confirmed by the buyer a confirmation mail/message will sent to the buyer for payment.
6. Once the message is received Buyer has 24 hours’ time to make payment. The order gets cancelled automatically after 24 hours and again the product will be made available for sale if the payment is not made.
7. Orders are confirmed once full payment is received.
8. Gokiddee is a reselling platform and as such will not be held responsible for any kind of guarantee, warranty, reliability of any kind for the product sold.
9. We do not accept Returns. All sales are final.

2. Use Of The Content

The content as has been made available and is made available from time to time on the Platform, excluding any information or content related to the Products (“Content”) is intended for informational purposes only. The term “Content” shall mean and include any content, advertisement or any other posts as posted by the Company on the Platform. The posting of the Content and access of the Platform by you does not constitute provision of Services by us, either explicitly or implicitly.

3. Authorise To Contact

You authorize the Company to call, send SMS and email or to contact you by any other similar means on the contact information (made available by you on the Platform either at the time of subscription, making an inquiry, making an application for any of the Services offered or otherwise), to offer you information about the Services or the Products you may have purchased or that you may be interested in. You authorize us to call, SMS or email or contact you by way of any other similar means for the mentioned purpose irrespective of whether you are registered with the NDNC registry.

We will also use your contact details information to:

• Send you information about the Services offered by the Company;
• To contact you through SMS and email for reminder notices, service request processing for the Services opted by you or the purchases made by you on the Platform; and
• To keep you updated on the Content through our newsletters.

In the event you do not wish to receive such information, you may unsubscribe through the facility in the communications you receive.

4. Modifications To The Service And Prices

Price for our products is subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

5. Accuracy Of Billing And Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
